Welcome to Appetite for Crayons. These Terms of Service ("Terms") govern your use of our website at appetiteforcrayons.com and all AI products and services offered by Appetite for Crayons, a brand of KMD Squared LLC ("we," "us," or "our"). By using our products, you agree to these Terms.

Our products are offered as subscription services billed on a recurring monthly basis through Stripe. By subscribing, you authorize us to charge your payment method on file each billing cycle. Prices are subject to change with 30 days' notice.

3. Cancellation & Refund Policy

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period — you will continue to have access to the product until then. No partial refunds are issued for unused time within a billing period.

Our products use artificial intelligence to process calls, generate responses, and perform tasks. While we strive for accuracy, AI systems are not infallible. Responses generated by our AI are not guaranteed to be 100% accurate in all situations. You are responsible for reviewing AI-generated outputs (such as call summaries and appointment bookings) and confirming their accuracy.

Our AI products are tools to assist your business — they do not constitute legal, medical, financial, or professional advice.

All content, code, AI models, branding, and materials on our website and in our products are owned by KMD Squared LLC and are protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our materials without written permission.

7. SMS/Text Messaging Terms

By opting in to receive text messages from Appetite for Crayons or from a business using our Aria AI answering service, you agree to the following:

7.1 Program Description. Appetite for Crayons (KMD Squared LLC) and businesses using our Aria AI answering service may send SMS and MMS text messages for the following purposes:

7.2 Opt-Out. You may opt out of receiving text messages at any time by replying STOP to any message. After opting out, you will receive one final confirmation message and no further messages will be sent unless you opt in again. You may also request removal by emailing hello@appetiteforcrayons.com or calling (615) 669-5643.

7.4 Message Frequency. Message frequency varies depending on your interactions. You will not receive more than 10 messages per month unless you initiate additional conversations.

7.5 Message and Data Rates. Message and data rates may apply. Appetite for Crayons does not charge for text messages, but your mobile carrier's standard messaging and data rates will apply. Check with your carrier for details about your plan.

7.6 Carrier Liability Disclaimer. Carriers (including but not limited to AT&T, T-Mobile, Verizon, and US Cellular) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier and network availability.

7.7 Age Restriction. You must be 18 years of age or older to opt in to receive text messages from us. By opting in, you confirm that you are at least 18 years old.

7.8 Consent. Consent to receive text messages is not required as a condition of purchasing any goods or services. You provide consent when you submit your phone number through a website form, verbally confirm your number during a call, text a keyword such as START or YES to a business number, or provide your number in person or via email for appointment scheduling.

Your use of our products is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Service Availability

We strive to maintain high uptime for all products. However, we do not guarantee uninterrupted service. Planned maintenance, third-party outages, or unforeseen circumstances may temporarily affect availability. We are not liable for damages resulting from service interruptions.

To the maximum extent permitted by law, Appetite for Crayons and KMD Squared LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products. Our total liability for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless KMD Squared LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our products or violation of these Terms.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our products after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Tennessee. Any disputes arising from these Terms shall be resolved in the courts of Tennessee.
